SHYFTER processes, on behalf of the Client, the data necessary for providing the services subscribed to under the Contract.
The purposes of the processing are determined by the Client, who is the Data Controller. As a data processor, SHYFTER undertakes to process the data only to the extent necessary, in accordance with the processing purposes determined by the Client and according to the documented instructions of the Client, except as required by any overriding legal provisions. SHYFTER commits to respecting the obligations incumbent upon it, as described in Appendix 1 of the General Terms and Conditions of Sale.

The Client, as the Data Controller, determines the applicable retention period for the data on its own systems, in accordance with the applicable regulations. Please consult the Privacy Policy of each Client for more information regarding these retention periods.
At the end of the service relationship, the data is made available to the Client on the Web Platform or, where applicable, on the Application for a period of two years from the end of the contractual relationship. After this period, the data is anonymized in SHYFTER’s IT systems, unless European Union law or Belgian law requires the retention of personal data.
Accordingly, SHYFTER will confirm in writing to the Client that the activities outlined in this section have been carried out, also mentioning any possible retention of the relevant personal data, as required by applicable law.
It is then the responsibility of the Client to take all necessary measures to ensure the integrity and backup of the data that SHYFTER provided during the execution of the Contract and after its termination.
Through its services, SHYFTER collects information on behalf of another organization (company, enterprise, and/or firm). In accordance with the GTC – “7. Database: The database generated by SHYFTER and its services will be made exclusively available to the signatory of the contract, who shall be solely responsible for it.”
We share the personal data that you have explicitly provided to us—and other non-automated data—only with other parties if we have obtained your explicit consent to do so, except where we are required by law, a request from a public authority, or a court decision.
As part of the execution of our services, we may also subcontract, in whole or in part, certain tasks to technical subcontractors who are bound to us by contract.
SHYFTER requires that its subcontractors comply with data protection legislation and provide sufficient guarantees regarding the implementation of appropriate technical and organizational measures so that the processing meets the requirements of applicable data protection legislation and ensures the protection of your rights.

Taking into account the state of the art, SHYFTER commits, under the conditions of Article 32 of the GDPR, to implement all appropriate Technical and Organizational Measures to secure Personal Data and maintain their adequate security—including protection against any form of imprudent, unskilled, or unlawful use and/or processing, as well as protection against loss, destruction, or damage—and to ensure the confidentiality and integrity of the data.
These provisions shall be governed by, interpreted, and enforced in accordance with Belgian law, which shall be the sole applicable law. In the event of any dispute that cannot be resolved amicably within one month of its occurrence (this period may be extended by mutual agreement), the matter may be brought before the French-speaking Courts of the Judicial District of Brussels, which shall have exclusive jurisdiction.
