French law (Articles 56 and 57 of the 5 March 2017 law) requires employers in the horeca sector to inform employees of their work schedules by a written, dated notice.

Methods of transmitting schedules

Employers can use modern technologies (email, text messages) to send schedules in real time. Mobile applications like Shyfter enable schedule transmission, modifications, and assignment of available shifts.

Timing requirements

Schedules must be communicated at least 5 working days in advance for variable work hours.

Exception

For the hotel sector, the deadline may be reduced to 48 hours with prior authorization.

Modifications of work schedules

Variable schedules

For employees with variable work hours, the new schedule must be announced within the required notice period as set out in the current work regulations.

Fixed schedules

For part-time employees with fixed hours, a modified schedule may be agreed upon. Written consent is advisable, and the new schedule should be appended to the employment contract.

Compliance

Any changes must adhere to the established work rules. In force majeure cases (e.g. Covid-19), deviations from these deadlines may be permitted to comply with government measures.
